IPS bought and installed a new Mitsubishi transmission in my car .
Even before I picked up the car IPS had called Mitsubishi about an internal problem with the transmission . Mitsubishi said the transmission is under warranty and it would be replaced .
Now IPS wants to charge me a 2nd labor fee to remove this bad transmission and put in another new one .

Give opinion on this

usually when a warranty issue arise an allowance is also included to cover removal/installation. If they exceed that amount you pick up the tab.

just my experiance with dealerships. dont think performance shops follow same rules

If you/IPS knew there was something wrong with it why was it installed?

I'm with this guy ^^

If you had it put in by a dealership I'm sure there wouldn't be an issue. Since you had a 3rd party shop install I'd expect to be hit with some labor fees. It sucks but thats the way it works.. IPS isn't getting paid by the manufacturer to replace your tranny again. In the end, it isn't their fault they installed a bad tranny.

It's not IPS fault, They just got it for you from the dealer and it was broke.
Now on something IPS makes then yes I think they should cover the labor. (IPS Built heads or blocks and you have them installed at IPS, and something was wrong with it or something Im sure IPS would cover labor. Now if you had the same parts installed at a different shop, then you should have to pay labor.)

Sucky situation... not your fault they put a bad tranny in..not their fault the tranny is bad. Mitsu won't cover the installation so you get stuck with it. I don't see any other way.

Take it up with Mitsu, that's your only chance. As everyone else said, IPS just installed the part, which was supposed to be new and defect free. Mitsu owes you the labor fee.

Background info:

Tranny was purchased directly from Mitsu and once fully installed it wouldnt stay in 5th gear. We got it back in and checked absolutely everything as it is pretty rare that a brand new Mitsu part is defective. Checked the Master/Slave and the clutch looked great while it was out. Spent multiple hours making 1000% sure that everything was done correctly on our end then called Mitsubishi. Even with the level of business we do with them (We are in the top 5 in total business each month behind a few very large body shops in Columbus) they said they wouldnt cover a penny towards labor. We argued and pleaded and tried to make deals but nothing changed. Sucks but it is what it is.

Best example I can think of is Tiki's car on here. His aftermarket water pump separated while driving and killed 10+ valves and shredded the T-belt and caused roughly $2000 worth of damage all said and done. Had that been a Mitsubishi pump failure he would have been out every penny since they dont warranty anything but the part itself. Since it was an aftermarket company located here in Columubus, we got 85% of the bill (Parts and Labor) covered for him.

Now, am I saying not to use Mitsubishi parts? Of course not. However, you need to understand going in that if something does fail and it needs replaced or it destroys something else which destroys something else nothing is going to be covered by them except the actual part (Think Matt M. @ Dynamic Racing's Mitsu Oil Pump failure that caused $20K+ worth of damage to the engine and not a penny of which was covered). This is true of 99% of the companies we deal with. Exedy, RPS, Spec, and probably every clutch manufacturer on the planet. Machine shops or engine builders. Distributors of JDM take-out engines. Turbo builders / distributors. I honestly don't know if I can think of a single exception except this water pump company here and I wouldnt have believed that one had it not happened to us.

It is the way this industry works. The "Shop" warranty ALWAYS falls back on whatever warranty the part manufacturer or distributor extends if there is a problem with a defective part -- or atleast that is what that this sign says I have hanging on the wall

It should also be noted that we offered to take the car over to Mitsubishi directly and have a tech there confirm it was an internal tranny issue on our dime (Just so there was no question) but Ed declined. So, we offered to do the swap at our cost as we had no desire to "Make" money on doing the job twice (It is obviously a sucky situation for everybody) but he declined again and instead did a charge-back with his CC company and called the BBB on us

Since I told him I called 15+ random shops (Service / Dealerships / Performance shops) and all of them said they would charge labor a second time if Mitsu wouldn't provide any money towards labor (Regardless of part) I guess we are going to confirm that here too
