Ok so I got pulled over 2 weeks back for doing "44 in a 35". I thought that was a bit ridiculous to begin with. The road is 2 lanes each way I figured it was at-least 40. Anyway I realize that where he pulled me over it was 40mph when he said the entire road was 35mph for miles and miles. My court date is coming and I took some pictures of where exactly my car was pulled over according to the ticket and you can see a 40mph speed limit sign about 200 ft behind my car also in the picture. Do I have any kind of case here. Any help/suggestions would be greatly appreciated.
I never abuse the speed limit and this is my first ticket. I feel like if I can convince the judge that 44 in a 40 is a little ridiculous i can talk it down or something. Thanks

You don't really need to prove your case. If you plead not guilty and go to court. They let you talk to the attorney there and they will most likely cut you a deal. I think that over 5 over is 4 points and as far as I know they will only plea you down to a lower speeding ticket so it will be 2 points. Now this is from my experience which has been more than i'd like to think about.
You may want to bring the pics just to show the attorney and maybe they will just take away the points if you can show that it was in fact 40 at that point and not 35. |

What town were you pulled over in, because those police are definitely hard asses. I would say you could plead it down to either 5 over or maybe if your lucky careless driving and end up with 1 or 0 points and just a fine. That would probably be your best bet. Because he could have clocked you a half mile back when it was 35.

Not from NJ but I've dealt with my share of tickets, to this day I still have not had to pay one of them. Most cases with speeding tickets and little things like that require the cop to show up in court otherwise the case is thrown out due to lack of evidence. Mainly because he is the only one who can say what happened that day. Also cops don't get paid to show up in court, its off the clock work. So sit at home and watch TV or go out and be on the job or go to court and not get paid?? Pretty simple choice for me. Could be different in NJ.
