46.2-100 VA Code refers to a street vehicle as in one that is street legal. So thats why the definition doesn't apply to off-road specific vehicles. He is applying the wrong definition to the car. Storage in VA would cost to much, when I can just store it in Florida. Hell, I would move it into my back yard behind the fence "out of sight" but a certain neighbor would report it again. They have a problem that I don't have to pay Virginia property taxes on my vehicles. I got tickets on my other cars, but had it thrown out because I'm active duty military and don't have to pay county car property taxes. Thats how this whole thing got started. Pathetic to say the least.

So did some researching and called the governor's office and got in touch with the Virginia Department of Transportation. Apparently, Prince William county codes legality is derived from Virginia state codes, however the Virginia state code does not apply to track vehicles, hence they can't apply the Prince William county code to this vehicle. There is another whole set of codes for off-road vehicles. I pulled the code out and stated this to the officer and he says it doesn't matter that I have to get a tag for the car, even though it can't be legally tagged with the Virginia DMV. As he told me unregistered cars devalue property, so I guess a pefectly sitting 3000GT in my driveway is apparently lowering someones property value. Mind you the thing looks fine from the outside, just different under the hood and of course a gutted interior, however the windows are heavily tinted. You can't see in it from the street. I don't crank the car up in my driveway and make noise or anything else.

I put in a formal appeal with the county executives office after the county representative from my district said the car is fine. He told me to call them if I had any other issues and to get the appeal in. We will see how this goes. If they indeed want a tag on the car, I'll put one on there if they would just call DMV and ask them to change their policy. The officer actually made a special trip to my house to tell me he usually sees the appeal first and that I still have to tag a car that the DMV won't issue a tag for.

Now what I could use, is feedback from members who have track cars or off-road use only vehicles in Virginia. Have you had to deal with a similar situation and what was the outcome?

I used to live in virginia and got cited by the local HOA for having a car on one jack stand .... because I took the rim off and took the tire to the tire shop to have it replaced. It took them overnight to do it. Nevermind the fact that somebody SLASHED my tire. F'n HOAs are junk. I moved to WV. Let 'em suck on that.

I had a car that wasn't tagged or inspected for well over a year. Only thing is, it was in my garage about 90% of the time. As long as the vehicle is registered with DMV, and you have a VA title, and it sits on private property ... I can't see a problem. You pay property taxes by having it registered. Inspection, safety, etc has nothing to do with property taxes.

I think that law is geared more towards vehicles sitting on blocks, not running, etc. My friends that track their cars do have tags and registration, though. Street and modified class, but not unlimited.

What in particular about the car wouldn't pass inspection? Also, what part of VA are you in around Prince William? They are getting as notorious as Fairfax lately.

Active duty military does not have to register their cars in Virginia. The car doesn't touch the street anymore. This is my small block V8 project car. I deregistered the title/tag in Florida a while back. Anyways, I kept the exterior fully intact, just a gutted interior with the cage I'm adding to it. Anyways, this car won't ever hit the street again unless I register in Florida as a custom car. Either way its sitting on all four tires and no jack stands. Like I say, I've got some asshole neighbor that thinks its unfair that I don't have to pay virginia property taxes on my car. The police officer was nice enough to give me that much info.
