Ok well about 3 months ago I was in a car accident. My best friend and I were takng a a sohc stealth out for a test drive. Well that day there were no cars anywhere in the first laneyou turn into when pulling got tired of waiting for the cars to pass so i figued the lane was clear i would pull out. Well right after I had already got the front fender some idiot jumps into the lane I'm pulling out into. He never signaled or anything jus jumped over. Well he hit us messed up the front fender on the car and knocked it up over the curb caussing the radiator to crack. The guy that hit us well my siter was in the car with him and she told me later hat he did it on purpose and that this wasnt the first tieme he's done that. Well both the insurance company's wouldnt cover the vehicles so they both took me to court and I got an attorney.
We had just got the case dismissed two weeks agoa and I was so happy to find out he turned back around and refiled. I was so pissed. I offered the guy the fender off of my vr4 because its the same year and told him coul buy him a new raiator and it would be fixed but he didnt want to do that. However he will let me buy it. I'm tired of going to court on it just spent the last 3 months doing it. You have attoreeney fee's and you loose money at work because you have to take days off. I already spent 800 on one and he wants 2000 for the car. I dont feel like getting another attorney. Another attorney will be about 800 and by then well i might as well of bought the car. I didnt the first time because he still wanted 4g after the accident. Too much.
Anyways it would put my vr4 project on hold for a month but then I'd have a runnng car and I can do some bigger upgrades on ethe vr4 since I'd have a running car.
So should i buy it or go back to court again for the second time? I jus see buying it being the best case scenario because if I loose then i'll still have to pay for the damages ontop of court fees attorney and so fourth.
You drove the car, your responsible. Either buy it or get an estimate to fix it and fix it. Somebodies insurance should have covered it. In Jersey, they share the damage if its not cut and dry, then they raise everybodies insurance or drop the guy with the sports car. However, when you take a car out on a test drive, its common sense that your responsible for its condition
Yeah I understand that but when you turn around and your siseter tells you he did in on purpose that she told him not to change lanes and he says watch this and does it. You cant prove thats what he did but if it was then he cause the accident on purpsose. His grandma gave him 3g less then a week later and he went and bought aa new car, Thats why I went to court the firt time.Secondly the dealer doesnt have insurance for anyone to drive the vehicle so he shouldnt be letting people drive it if isurance wont cover it. No tickets were issued for the accidentand by state law if their is an accident someone has to get a ticket. His dad is the head detective here in town so thats probably why tickets werent issued.
Anyways all i'm saying is the kid hit me on purpose went to court already and got it all dismissed but the could still refile so he did and i never had a problem with buying the car but he want $4,000 for the car and it has 190,000 miles on it. Offered to buy new fender paint it and new raduiator and it would be just like before the accident but he wont do that he just wants to sell it its been on his lot for 5 months.Now heis willing to take 2grand i think that is resonable.
Automotive dealerships are required to carry insurance to cover this. I would speak to an attorney about this.

I did not know it was a used dealer with no insurance. Fuck em, dont pay him shit. He should not have let u drive w/o insurance. What is he going to do if you dont pay? Is it just to avoid going to court over it? Isn't your a sister a witness to attest that the guy did it on purpose?

What you're saying is you test drove a car and while you were changing lanes another car PURPOSELY swerved just to hit you?
Are you saying YOUR sister knows the guy and just happened to be in the car and he told her he was going to hit you on purpose. Or are you saying the guy who hit you had his sister in the car and HIS own sister is claiming he told her he was going to hit you on purpose.
The only other thing is this is not your responsibility to insure this car.... you don't even own it. Dealers have to have insurance for anyone test driving their cars in the event this exact situation happens... if this was not a dealership you're kinda screwed on that though.
im lost story is totally confusing me ive read it like 3 times and still lost...
but usually in most cases 1 of the 2 people in the accident are deemed at fault thats a no brainer.. being that neither of u got a ticket... then thats a plus... but.... if he hit you and you were in your lane and didnt pull out in front of him thats his fault all day long he hit you you didnt hit him
